    Abstract
    This article explores the interpretation of 'equal ' treatment and proportionality of punishment in relation to mothers and fathers sentenced to custody . It argues that 'punishment' is often disproportionate in relation to women , specifically mothers as many - even on very short sentences will lose their homes and their children - in greater number than when their male counterparts are sentenced to custody.
